15.1. Payment Due
Fines, Fees and Assessments must be paid within 30 days. Failure to do so will result in the Member being considered not In Good Standing and denied the use of Resort facilities and all current reservations may be cancelled until the fee is paid.
15.2. Collection
Unpaid Fines and Fees or any other Assessments may be added to the Maintenance Fee Assessment for collection purposes.

15.2.2. Unpaid Fees and Fines
When a Membership is forfeited or withdrawn with unpaid fees or fines, these unpaid amounts may be applied to any other Membership owned by the same Member or Members.
15.3. Assessment Billing and Collection (ABC Policy)
15.3.1. Administration
The Assessment Billing and Collection Policy (ABC) of ECR will be administered by ECR or by a company contracted to perform such services.
15.3.2. Billing Statement
An annual Billing Statement for the next year's Assessment will be mailed to each Member approximately March 1st each year. The Member has an option to pay the assessment in full upon receipt of the billing statement or pay the assessment quarterly, semiannually or in twelve (12) equal monthly installments which will include a Processing Fee.
15.3.3. Payment Selection
If payment in full is not received or satisfactory arrangements are not made by April 15th, a monthly invoice will be sent to the Member and the Member becomes liable for the additional processing fee.
15.3.4. Rescinded 1/23/2014
15.3.5. Payment Due
The first monthly payment will be due April 1st with each subsequent payment being due the first of each month thereafter.
15.4. Delinquency
15.4.1. Late Fee
Except for the month of April, any payments made after the 15th of the month due are considered late. A late fee of 10% of the payment will be added to the Member's account. If any portion of the Member's account becomes more than six (6) months past due, an additional charge of 1% of the entire past due amount will be added to the account monthly until the account is brought current or forfeited.
15.4.2. Thirty (30) Days
if a Member becomes thirty (30) days past due, the Member will not be permitted to make a Reservation nor use the Resort facilities. The Member will receive an invoice stating that any Reservations or Exchange(s) will be cancelled if any past due amount is not received within thirty (30) days.
15.4.3. Sixty (60) Days
If any payment becomes sixty (60) days delinquent, existing Reservations (including Exchanges) may be canceled without notice and Exchange requests will not be confirmed.
15.4.4. Ninety (90) Days
If a Member becomes ninety (90) days delinquent, they will receive a Demand Letter requesting immediate payment for all past due amounts and actions to cancel the ECR Membership certificate may commence.
15.4.5. Reinstatement
For a period of one (1) year after a Membership has been cancelled, Members will be granted the opportunity to acquire a Membership of the same class as the Forfeited Membership, if such stock is available from the Resort's unsold inventory, upon payment of the
following: An amount equal to the total of all assessments, late fees, billing fees and all other charges that would have been made against the account up to the date of payment if the ECR Stock Certificate had not been canceled.
15.4.6. Collections
The Board of Directors may, at its discretion, implement any of the following actions. Any related costs for these actions will be added to the delinquent owner's account. a. Engage professional collection agencies to collect payment. b. Institute a Small Claims suit or other legal action. c. Proceed to forfeit your stock certificate to the Resort and terminate your membership.
