4. USE OF FACILITIES

4.1. General

4.1.1. General Public

The General Public is only permitted to use the Resort facilities or land as invited for specific events or activities as authorized by the Board of Directors. The General Public is invited to use the laundry, lodge and the country store.

4.1.2. Non-Members

ECR may ask anyone not a Member or Guest (in other words a person of the General Public), who is in violation of any of these Rules and Regulations, to leave the Resort. ECR may pursue trespass enforcement with appropriate law enforcement agencies.

4.1.3. Facility Rental

ECR may rent Resort facilities, as authorized by the Board of Directors, to businesses or individuals for conventions, meetings, wedding receptions, social gatherings or personal use providing the use of any Resort facilities by the Renters does not significantly adversely affect the Members' use of the Resort. Renters may use only those Resort facilities and areas specifically permitted in their Rental Agreement.

4.1.4. Regular Time Use by Others

Members' Regular Time for Condos may be rented or given away to anyone over 21 years of age. The Member must make the reservation and provide the guest information at the time the reservation is made. The Member is responsible as stated in Rule 3.4. Bonus Time and RV Park Use may not be rented or given away.

4.1.5. Proper Care

Upon a Resort inspection during or after a Visitors' occupancy which identifies damage to any of the Resort's property, the Visitor is liable for the cost of repair or replacement of the Resort's damaged property caused by that Visitor.

4.1.6. Non-Interference

Users of Resort facilities shall conduct their activities so as not to interfere with the safety, rights and enjoyment of others using the Resort facilities. Failure to maintain proper conduct may result in denial of Use Privileges.

4.1.7. Emergencies- In the event of unforeseen or

emergency conditions, ECR Management may temporarily close or restrict all or any portion of the Resort and its Use.

4.1.8. Signs

All Visitors shall observe and obey posted regulatory signs. See Appendix A for penalty.

4.1.9. Check Out

All persons shall vacate the Condos on or before 10:00 am on the last day of the Reservation. The RV Park Site, Wilderness Area Campsite, or Tent Site must vacate on or before 12:00 noon on the last day of the reservation. Family Reunion Sites must be vacated on or before 11:00 am on the last day of the reservation. Resort facilities are rented on a daily basis and must be vacated on or before 10 PM of their reserved date. See Appendix A for penalty.

4.1.10. Vehicle/Trailer Washing- Use of culinary water for

washing vehicles or trailers is not allowed. See Appendix A for penalty.

4.1.11. Horses

Horse owners are responsible for taking care of and cleaning up after their horses. Waste areas will be designated by ECR. Horses are not allowed around the Condos or RV Park. See Appendix A for penalty.

4.1.12. Parking

No person shall park a vehicle in such a way that it: 1) Prevents another person's vehicle from being safely moved or 2) blocks any firefighting apparatus or equipment or 3) blocks a road or prevents the safe use of a road or 4) is parked on the lawn, shrubs, or flower beds or 5) is in the North of Condo Parking Area unless hooked to a trailer (See Rule 13.7). All vehicles must be parked on the pavement. Parking at ECR is restricted to Members and Guests present at the resort, except as provided elsewhere in these Rules. See Appendix A for penalty.

4.1.13. Overnight Occupancy

Overnight occupancy in the Developed Area of the Resort is permitted only in a Tent, RV, or Condo. No overnight occupancy is permitted in vehicles (other than RV's), out of doors, or in any common areas of the Developed Area of the Resort.

4.1.14. Riding Toys

No riding toys are allowed in the playground. Gas powered riding toys are not permitted at the Lodge, Condo or RV Park areas, except as per Rule 13.3 when used for Handicap purposes. Foot propelled toys are not permitted where prohibited by posted signs. Tickets will be issued to the member for anyone exceeding posted speed limits. See Appendix A for penalty.

4.1.15. Quiet Hours

Quiet hours for all of ECR shall be observed from 11PM to 7AM. Amended February 22, 2024.

4.1.16. No Commercial Use

No Member or Guest may use the Resort for commercial purposes. Renting Regular Use Time in the Condos is not a commercial purpose. For the purpose of ECR Rules, commercial use includes nonprofit and fundraising events.

4.1.17. No Illegal Activities

No illegal activities may be conducted on the Resort. ECR may, in addition to Fines provided for elsewhere in these Rules and Regulations, evict, or deny Resort Use to any person which ECR has reason to believe has acted illegally, is acting illegally, or will act illegally on the Resort.

4.1.18. Underage Visitors

No person under age twentyone (21) may use the Resort unless accompanied by a person age twenty-one (21) years or older, except for married couples without Guests.

4.1.19. Smoking

Smoking restrictions vary according to the fire condition of the Resort property. The restrictions are available at check-in and will be posted. Smoking rules vary depending on Use area. See Appendix A for penalty.

4.1.20. Fires

Fires shall be built only in concrete, metal prepared fire pits or in approved enclosed portable fireplaces and shall be completely extinguished before leaving. Deadwood located on Resort property may be used for campfires, but firewood may not be taken off the Resort property for use elsewhere without the written permission of ECR. All posted Fire Rules must be followed. See Appendix A for penalty.

4.1.21. Removal or Destruction of Trees, Plants, Rocks

or Soil -The removal of live trees, plants, rocks or soil, from Resort property or the destruction of same is strictly prohibited. NO LIVE TREES shall be cut for use as firewood or for any other purpose. See Appendix A for penalty.

4.1.22. Gaming Courts

Gaming courts and court equipment are on a first come-first serve basis. 1 Member can occupy 1 sporting court for 1 hour at a time. This is a self-policed system; however, areas are monitored by cameras and security. Management can assist with any member disputes. Children under the age of 16 are always to be accompanied by an adult. Reservations are available for Pickleball Courts only. Please check with front desk staff to learn more regarding reservation regulations. Amended March 21, 2024.

4.1.23. Hammocks

Only free-standing hammocks are allowed.

4.1.24. Check-in

A Membership photo ID or Government issued ID with picture is required for any person checking in for RV, Condo, Wilderness, or to receive gate codes. Checkin or gate codes will be denied for any person whose member status cannot be positively verified. Checking in or attempting to Check-in using another person's ID will result in a fine. See Appendix A for penalty. Amended February 22,

4.2. Firearms, Hunting & Trespassing

4.2.1. Hunting Regulations

No person may hunt on ECR property except in accordance with the Hunting Laws, Rules,

Policies, and Regulations of the State of Utah and ECR. See Appendix C for Hunt Rules. See Appendix A for penalty.

4.2.2. Weapon Discharge

No firearm shall be discharged on ECR property except 1) During hunting season in designated hunting areas and in accordance with Hunting laws, Rules, and Regulations of the State of Utah and ECR, or 2) at the rifle range in Rabbit Hollow during daylight hours, 3) as authorized by Resort Management. If the shooter is less than eighteen (18) years of age adult supervision is required. Discharge of any firearm or weapon in the Condo area, RV Park, FRA or any designated Wilderness Camping Area or within 600 feet of any Resort building is strictly prohibited. Violation of Firearm Regulations may result in fines, eviction from Resort property and possible suspension of some or all Use Privileges at ECR or possible termination of Membership by the Board of Directors. See Appendix A for penalty.

4.2.3. Firearms

A person may not carry a loaded firearm in or on a vehicle. Pistols and revolvers must have an empty chamber, and the cylinder placed in an out-of-firing position. All firearms in condominiums, RV Park, all other buildings and within 600 feet of any buildings must be completely unloaded and no such firearm may contain live ammunition in the chamber or the magazine. A holder of a current Concealed Firearm Permit recognized by the State of Utah is exempt from this paragraph while acting within the applicable laws. Violation may result in eviction and possible suspension of some or all Use Privileges at ECR or possible termination of Membership by the Board of Directors. See Appendix A for penalty.

4.2.4. Poaching

No Member or Guest of ECR may take any game on adjacent private property without permission of the land owner and UDWR. Violation may result in eviction, suspension of Hunting Privileges for the remainder of the year and the following two years and possible suspension of use of some or all ECR privileges or possible termination of Membership by the Board of Directors. See Appendix A for penalty.

4.2.5. Trespassing

No Member or Guest of ECR may trespass on adjacent or nearby private property without written permission of the land owner. No Member or Guest of ECR may cause damage, including but not limited to, road damage on adjacent or nearby private, USFS, BOR or Salt Lake City Corporation property. See Appendix A for penalty.

4.2.6. Parking

There is no overnight parking (except in designated parking areas) of motorized vehicles in any wilderness area. Violation of this rule will constitute a termination of the Membership's current season hunting privileges. Exceptions: 1) Hunting the Great Western Trail where parking will be allowed at Swallow Rock, or 2) if a vehicle becomes disabled. If the vehicle is disabled, you must contact a member of security for a rule waiver and/or removal. See Appendix A for penalty.

4.3. Fishing

4.3.1. Regulations

Anyone fishing anywhere on Resort property must comply with Fishing Laws and Regulations of the State of Utah.

4.3.2. Children's Fish Pond

Fishing in the designated

Children's Fishing Pond is restricted to children 12 years old and younger and the limit is three (3) fish per day per child.

4.3.3. Fish Pond Use

The fishing pond is for fishing only. No swimming, floatation devices, nor watercraft of any kind are permitted in the fishing pond.

4.4. Locked Gates

4.4.1. Re-Lock Gates

Whenever entering or leaving areas of the Resort property where Gates are located the Gates shall be re-locked.

4.4.2. Obtaining Combinations

A Full Member in Good Standing or Relative Rights Member may obtain the current lock combination in person at the Resort or have it sent to a pre-arranged email. Full Members or RRM are prohibited from distributing gate codes to other Visitors or Members. Full Members or Relative Rights Members found in violation of this rule may be subject to a fine as determined appropriate by ECR Management.

4.4.3. Authorized Entrance

No vehicle shall enter any gated area except as authorized. Driving around the gate is strictly prohibited.

4.5. Swimming Pool and Hot Tub

4.5.1. Swim Tags

No one may use the swimming pool or hot tub without displaying a swim tag except for use of the hot tub in the winter.

4.5.2. Adult Supervision

The Member must ensure adequate adult supervision in the pool area for those using the Member's swim tags. Children aged 12 years and younger must be accompanied by a person 18 years or older.

4.5.3. Age Restrictions

No one under 16 is allowed to use the Hot Tub.

4.5.4. Food in Pool Area

No alcohol, food or glass containers are allowed in Pool Area.

4.5.5. Violations

Any violation in the swimming pool or hot tub areas may result in forfeiture of swim tags and removal from the pool area in addition to fines. See Appendix A for penalty.

4.5.6. Swim Diapers

Children who are not yet toilet trained must wear Swim Diapers in the pool or children's wading pool. Swim Diapers are specially made to prevent the spread of E-Coli and other waterborne diseases.

4.5.7. Smoking

No Smoking is allowed at the Pool and Hot Tub areas.

4.6. Lodge Mezzanine/Activities Center

4.6.1. Reservation Use

During the time period of November 1st - April 30th the Lodge Mezzanine and Activities Center may be rented on a first-come-first served basis by a Visitor for gatherings such as meetings, receptions, parties, etc. Visitors are responsible for all clean up and will be

charged a fee for any additional services as determined by ECR Management. See Appendix B for pricing.

4.7. Condos General Uses

4.7.1. Overnight Occupancy

Overnight Occupancy of a Condo is limited to eight (8) persons except that up to twelve (12) persons may occupy a Condo overnight if the twelve (12) persons are the Member, Member's spouse, and Member's children (no other Guests). See Appendix A for penalty.

4.7.2. Condo Parking

Parking next to a Condo is limited to two (2) vehicles per Condo either powered or pulled. From November 1st to March 31st parking will be restricted to one (1) vehicle per condo unit and the vehicle is required to be parked under the carport. All vehicles must be parked on the pavement and any vehicle parked North of the Condo must comply with Rule 13.7. See Appendix A for penalty.

4.7.3. Non-member Condo Rental

Rental of condos by a non-member allows the same use of all resort property and facilities during their rental stay subject to the rules and regulations of ECR. Hunting privileges are not included. 4.7.4 - Electric Bicycles and Scooters - Members and guests are prohibited from storage or charging e-mobility device batteries inside of a dwelling space. ADA devices are excluded from this rule. Added May 23,2024.

4.8. Vehicle Speed Limits

No vehicle may be operated on improved Resort property or roads adjacent to the

Wilderness Area campsites in excess of 10 miles per hour. OHVs are restricted to 10 miles per hour in these areas.

4.9. RV Park General Uses

4.9.1. Check In, Check Out

All RVs must Check In and Check Out at the desk. The Check In time is 2:00 p.m. on the day of arrival and Check Out time is 12:00 noon on the day of departure.

4.9.2. One RV

Only one (1) RV may be parked on a pad at any time.

4.9.3. Parking

No vehicle may be parked on the access roads. These roads must be kept clear for use by other Members and for maintenance and emergency vehicles. See Appendix A for penalty.

4.9.4. Tents

No tents are allowed in the RV Park.

4.9.5. Unattended RV

RV may not be left unattended overnight in the RV Park without prior approval of Resort management. See Appendix A for penalty.

4.9.6. RV Removal

The RV owner is responsible for any damage incurred if ECR removes an RV which is in violation of Resort policy.

4.9.7. Conduct

Users of the RV Park will not disturb their neighbors and shall not make or allow loud or offensive noises.

4.9.8. Parking Pass

Any vehicle parked on a RV Park Site

must display a valid parking pass for that date and RV Park Site. Non-complying vehicles may be towed at owner's expense.

4.9.9. Unassigned RV Site

No person shall use an RV Park Site not assigned to them as evidenced by a valid parking pass for that date and RV Park Site. This includes, but is not limited to: water, sewer, power, and TV hookups; the parking pad and its associated amenities and lawn area; or personal property offered for use on the Site by ECR. See Appendix A for penalty.

4.9.10. "Y" Hose Connection

A "Y" Hose Connection may not be used in the RV Park. See Appendix A for penalty.

4.9.11. No Carpeting

No carpeting, mats, plastic sheets or other coverings may be placed on the grass. See Appendix A for penalty.

4.9.12. Sewer Connections

A secure sewer boot is required. See Appendix A for penalty.

4.9.13. Portable Fire Pits

Portable Fire pits may be used only on provided pads or the graveled area and may not damage grass or landscaping. See Appendix A for penalty.

4.9.14. Winter RV Storage

There is no winter storage in the RV Park.

4.10. Drones

Operation or use of drones is prohibited within 500 feet of any developed area of the resort. Drone use is prohibited on all ECR property during the hunting

season of August - February.

4.11. Guests

One (1) Guest may stay up to three (3) nights in the RV Park (fee applicable) and up to three (3) tents in the tent area (fee applicable) only if the inviting Member is also staying overnight in the Developed Area. Guest(s) shall always be accompanied by the Member when accessing ECR gates and Wilderness Areas. Failure to be accompanied by the Member may result in removal from the property and a fine being assessed. See Appendix A for penalty and Appendix B for fee.
